Judge Tosses Download Royalties Suit Against Sony

Law360, New York (June 19, 2008, 12:00 AM EDT) -- A proposed class action against Sony BMG Music Entertainment Inc. challenging the royalties received by musicians when their songs are sold as downloads or ringtones has been dismissed by a federal judge, but an attorney for the artists says the case isn't over.

The suit was filed in 2006 by members of the 1970s groups Cheap Trick and The Allman Brothers Band, along with Elmo Shropshire, who sang “Grandma Got Run Over By A Reindeer.” They sought to represent a class of at least 2,500 artists,...
