Same-Sex Marriage: What Employers Need To Know

Law360, New York (July 2, 2008, 12:00 AM EDT) -- On May 15, 2008, the California Supreme Court ruled that gay and lesbian couples have a constitutional right to marry. The court’s landmark decision in In re Marriage Cases makes California only the second state after Massachusetts to so hold.

California employers likely will not have to make drastic changes to their policies and benefit programs because, since 2005, California’s domestic partnership laws have required employers to extend to same-sex domestic partners the same rights and benefits enjoyed by married couples.
