EBay Notches Win In Tiffany Trademark Dispute

Law360, New York (July 14, 2008, 12:00 AM EDT) -- Tiffany & Co. was unable to pin trademark infringement claims onto eBay Inc. in a district court ruling that could boost the online auctioneer’s defense in similar disputes.

Tiffany had accused eBay of not doing enough to prevent fake Tiffany silver jewelry from being sold on its Web site, but Judge Richard Sullivan of the U.S. District Court for the Southern District of New York said on Monday that Tiffany did not show how eBay was liable for violations of trademark law.
