Fox News Settles Fair Use Case Over 9/11 Facebook Photo

By Bill Donahue (April 15, 2015, 3:10 PM EDT) -- Fox News Network has settled a lawsuit over the posting of a copyrighted photo from Sept. 11, 2001, to Facebook, leaving in place a ruling that the network warned last month could have "massive implications" for how the fair use doctrine is applied to social media.

The notice of settlement filed Wednesday came as Fox was seeking to overturn a federal judge's February refusal to rule that the network was protected by the fair use doctrine when it posted the iconic "Raising the Flag at Ground Zero," a photo owned by a New Jersey newspaper.
