AT&T Stuck With Sidley Blown Deadline Ruling, Fed. Circ. Told

By Kelly Knaub (May 11, 2015, 4:59 PM EDT) -- Two-Way Media LLC urged the Federal Circuit to deny AT&T Inc. an en banc review of the court's refusal to let AT&T appeal a $40 million patent infringement verdict after its Sidley Austin LLP attorneys missed the appeal deadline, saying Friday that AT&T didn't establish legal error.

Two-Way rejected AT&T's argument that under the Federal Rules of Appellate Procedure, the district court never gave proper notice of when post-trial motions were resolved, which would begin the 30-day period for filing an appeal, contending that AT&T indisputably received notice of the three orders at issue.
