EnCap, Creditors Fight Wachovia Bid To Toss Ch. 11

Law360, New York (August 11, 2008, 12:00 AM EDT) -- Bankrupt environmental remediator and real estate developer EnCap Golf Holdings LLC and its creditors are fighting administrative agent Wachovia Bank NA’s motion to dismiss its Chapter 11 case, claiming the bankruptcy filing is in the best interest of EnCap’s stakeholders.

Both the debtors, which include EnCap and its majority owner NJM Capital LLC, and the official committee of unsecured creditors filed objections Friday in the U.S. Bankruptcy Court for the District of New Jersey opposing Wachovia’s bid to bring an end to the Chapter 11 proceedings....
