Levee Board Asks 5th Circ. To Revive Coastal Damage Suit
Law360, New York (May 21, 2015, 8:17 PM EDT) -- A Louisiana state levee board on Wednesday asked the Fifth Circuit to overturn a federal judge's February decision to toss its multibillion-dollar suit against 88 energy companies including BP PLC, Chevron Corp. and ConocoPhillips Co. over alleged oil and gas drilling damage to coastal ecosystems.
In its opening brief to the appeals court, the Board of Commissioners of the Southeast Louisiana Flood Protection Authority-East said a district court erred in denying its motion to remand the lawsuit to Louisiana state court, and in holding the authority failed to state a claim for negligence, among other things.
