Retired Pilots Win Ruling In Delta Case

Law360, New York (May 16, 2006, 12:00 AM EDT) -- The retired pilots of beleaguered Delta Air Lines Inc. celebrated a small victory last week when Judge Leonard B. Sands ruled that the bankruptcy court erred when it denied the pilots’ requests that Delta be forced to make pension payments.

The motion filed by the Delta Pilots’ Pension Preservation Organization (DP3), a pilot retiree group, had been denied earlier on the basis of a legal technicality that only Delta can use the bankruptcy code to modify pension or other benefits to union employees.
