Judge Tosses $533M Verdict Against Apple In Patent Row

Law360, Los Angeles (July 7, 2015, 10:27 PM EDT) -- A Texas federal judge on Tuesday granted Apple Inc. a second bite at damages in a patent infringement suit, tossing a $533 million verdict over an errant instruction that skewed the jury's view of how much the tech giant should pay for using Smartflash LLC's media storage technology.

U.S. District Judge Rodney Gilstrap granted Apple a new trial on the issue, finding that his instruction to the jury on the meaning of the entire market value rule might have confused the group about what damages should be awarded to Smartflash in the case, according to an order issued Tuesday.
