3rd-Party Payer Class Certified In Zyprexa MDL

Law360, New York (September 8, 2008, 12:00 AM EDT) -- A federal judge has granted certification to a class of third-party payers suing for overpayment on Eli Lilly and Co.'s anti-psychotic Zyprexa, but has denied certification for individual payer claims.

In the U.S. District Court for the Eastern District of New York, Judge Jack Weinstein set in motion on Friday a class action alleging that Lilly violated the federal Racketeer Influenced and Corrupt Organizations Act.

Judge Weinstein declined to rule on a class certification on state-based claims.
