Forest Labs Jumping Gun In $100M Sex-Bias Suit, Court Told
Law360, New York (August 13, 2015, 6:44 PM EDT) -- Female workers who filed a $100 million gender bias suit against Forest Laboratories Inc. on Thursday renewed their push for a New York federal court to grant them class certification, asking the court to reject the drugmaker's "premature" argument that they can't meet the requirements to gain certification.
The plaintiffs, accusing the Actavis PLC subsidiary of widespread discrimination against female sales representatives, argued in their reply brief that they have met the basic requirement for class certification at this stage in the proceeding, and that Forest's opposition brief gets too deep into the weeds too early.
