IBM Tries To Move Overtime Suit To Federal Court

Law360 (September 22, 2008, 12:00 AM EDT) -- IBM Corp. has sought to transfer to federal court a putative class action filed by an employee who alleges the company misclassified certain workers as exempt from overtime payments due to the size of the proposed class and the sum of the matter in controversy.

In a notice of removal filed Friday in the U.S. District Court for the Southern District of California, IBM Corp. sought to transfer the case from the California Superior Court.
