Rather Suffers Setback In $70M CBS, Viacom Suit

Law360, New York (September 23, 2008, 12:00 AM EDT) -- A New York state judge has thrown out Dan Rather's fraud and tortious interference claims against CBS Corp. and completely tossed claims against CBS' former parent company Viacom Inc., but other claims still remain in the $70 million suit.

Judge Ira Gammerman of the New York State Supreme Court dismissed Rather's claims against Viacom after allowing the ousted anchorman to amend his complaint against the two entities earlier this year, Dow Jones reported Monday.

However, the judge did permit breach-of-contract and breach-of-fiduciary claims to move forward...
