Apple Retrial In $533M Smartflash Case On Hold For Appeal

Law360, Los Angeles (September 17, 2015, 7:55 PM EDT) -- Apple Inc. won its bid to postpone a retrial on damages while it appeals a jury’s finding that it infringed Smartflash LLC’s media storage patents, after a Texas federal judge ruled the liability issue should be determined before damages go forward, according to a Thursday filing.

U.S. District Judge Rodney Gilstrap ordered the currently scheduled Nov. 2 jury selection for the trial removed from the docket and paused the retrial during the appeal, according to a filing. Apple had said it would file a formal notice of appeal by Oct. 2.
