Class Certification Flies In Boeing ERISA Suit

Law360, New York (September 30, 2008, 12:00 AM EDT) -- A federal judge on Friday gave a big lift to plaintiffs in an ERISA suit against the Boeing Co., granting class certification to three benefit plan participants who allege Boeing failed to contain the costs associated with its 401(k) plan.

Judge David R. Herndon of the U.S. District Court for the Southern District of Illinois approved class status to three participants in Boeing’s 401(k) plan, establishing a plaintiffs class consisting of past and future participants and beneficiaries of the plan.
