9th Circ. Upholds Employer-Funded Health Care Law

Law360, New York (October 1, 2008, 12:00 AM EDT) -- The U.S. Court of Appeals for the Ninth Circuit has sided against a group representing restaurant operators, rejecting the argument that ERISA prevents San Francisco from implementing a controversial program requiring employers to spend a specific sum on employees' health care.

On Tuesday, the Ninth Circuit dealt a significant blow to the Golden Gate Restaurant Association, unpersuaded that federal employment law prevented the city and labor groups from insisting on employer-provided health care.
