Staples Wage-And-Hour Suit Stays Alive

Law360, New York (October 1, 2008, 12:00 AM EDT) -- A federal judge has rejected Staples Inc.'s attempt to dismiss a proposed class action that accuses the office products company of violating state minimum wage and overtime laws.

In an opinion issued Monday, Judge Donetta W. Ambrose of the U.S. District Court for the Western District of Pennsylvania said the complaint did not include any federal claims, and that it was therefore not preempted by the Fair Labor Standards Act.
