Judge Taps Lead Plaintiff, Counsel In Wachovia Case

Law360, New York (October 15, 2008, 12:00 AM EDT) -- After some jockeying among plaintiffs, a judge has picked New York City Pension Funds to serve as lead plaintiff and Kirby McInerney LLP to represent it in a securities putative class action brought against Wachovia Corp. alleging it misrepresented its mortgage-based holdings.

In an order filed Tuesday and signed Oct. 9, Judge Richard J. Sullivan of the U.S. District Court for the Southern District of New York picked the funds over the Fulton County Employees Retirement System, which is counseled by Scott & Scott LLP....
