Lawyer Sanctions Denied In HSBC Overtime Case

Law360, New York (October 15, 2008, 12:00 AM EDT) -- A judge has denied HSBC Mortgage Corp.'s motion to sanction a plaintiffs attorney for allegedly instructing a class representative to destroy evidence in an overtime, meal and rest period compensation and unlawful deductions suit.

Judge Maxine M. Chesney denied the motion Wednesday in a five-sentence order in the U.S. District Court for the Northern District of California, describing it as “procedurally improper.”
