Broadcom Ordered To Return $11M In Patent Royalties

Law360 (October 29, 2008, 12:00 AM EDT) -- A federal judge ordered Broadcom Corp. on Wednesday to return $11 million in royalties it received from Qualcomm Inc. for use of a patent that was recently declared invalid in their infringement dispute over cellular chips and software.

In an apparent case of first impression, Judge James V. Selna of the U.S. District Court for the Central District of California found Qualcomm was entitled to recover sunset royalties it paid to Broadcom under a permanent injunction order that was later reversed.
