Supreme Court Again Clarifies Standards For ERISA Claims

Law360, New York (January 26, 2016, 8:11 PM EST) -- The U.S. Supreme Court has again ventured into the treacherous waters of trying to clarify when a plaintiff has brought a valid claim against the administrators of a company's employee stock fund for breaching their fiduciary duties to the fund. Moreover, the means to that end involved slapping down for the second time in the same matter a decision by the Ninth Circuit Court of Appeals holding that such a claim was valid. Also, the court expressed frustration that a lower court had ignored the standards established in a prior decision by the court, a telling message that extends beyond the four corners of this one decision....
