Foam Cos.' $151M Price-Fixing MDL Settlement Gets Final OK
Law360, New York (January 27, 2016, 8:57 PM EST) -- An Ohio federal judge on Wednesday stamped his final approval on a $151.3 million settlement between consumers and nine makers of flexible polyurethane foam accused of engaging in a decadelong conspiracy to fix prices, putting to bed five years of multidistrict litigation.
After hearing objections and considering the proportion of payment to the settlement class, U.S. District Judge Jack Zouhary said the $151.3 million deal — purportedly the fourth-largest antitrust recovery obtained by so-called indirect purchasers in the U.S. — provided a substantial benefit to the consumers of the foam products, considering the difficulty faced had they proceeded to trial against...
