Court Throws Out Suit Over Ad-Skipping Technology

Law360, New York (January 13, 2004, 12:00 AM EST) -- The U.S. District Court for the District of Central California dismissed a case brought by customers of ReplayTV against major broadcasters, cable networks and studios over the right to skip over commercials when recording television programs for later viewing.

The suit, filed by civil liberties group the Electronic Frontier Foundation (EFF) on behalf of five individuals in June 2002, had asked for a declaratory ruling that their use of the ReplayTV device is legal under copyright law.
