Magistrate Wants To Deny Class In Casket Case

Law360, New York (November 25, 2008, 12:00 AM EST) -- A magistrate judge has recommended denying class status to a consumer group represented by the Funeral Consumers Alliance, in a case alleging funeral homes and casket makers conspired to fix prices.

U.S. Magistrate Judge Calvin Botley of the U.S. District Court for the Southern District of Texas made the recommendation on Monday. He reasoned that “highly individualized factors” affected the prices of their caskets, so the consumers couldn't pursue a common claim.
