Wachovia Tries Again To Get EnCap Ch. 11 Tossed

Law360 (December 1, 2008, 12:00 AM EST) -- Wachovia Bank NA has renewed its attempt to have two Chapter 11 cases related to environmental remediator and real estate developer EnCap Golf Holdings LLC dismissed, alleging the debtors have failed to file a confirmable plan.

The bank's motion, filed Wednesday in the U.S. Bankruptcy Court for the District of New Jersey, seeks dismissal of the cases for cause or an order allowing Wachovia to prosecute a foreclosure action against EnCap, which according to court papers is millions of dollars behind on real estate taxes....
