Airborne Settles Multistate False Ad Probe For $7M

Law360 (December 16, 2008, 12:00 AM EST) -- Leading dietary supplement maker Airborne Health Inc. has coughed up $7 million to settle a multistate suit claiming the company’s advertisements falsely touted Airborne’s power to prevent colds.

In what rates as the largest multistate settlement with a dietary supplement company to date, attorneys general for 32 states and the District of Columbia agreed Tuesday to resolve allegations that Airborne labeled and marketed its “cold prevention remedy” without adequate proof that the effervescent tablets actually helped combat illness.
