Pepsi Reaches Settlement In Suit Over Carcinogen Content

Law360, New York (June 28, 2016, 8:22 PM EDT) -- A California federal judge granted preliminary approval Tuesday of a settlement in a class action alleging PepsiCo Inc. soft drinks contained elevated levels of a potential carcinogen that will see the beverage giant monitor the levels of caramel coloring in its products.

U.S. District Judge Edward M. Chen put his preliminary stamp on the settlement, in which Pepsi agreed to make sure its caramel coloring suppliers meet certain levels of 4-Methylimidazole, known as 4-Mel, in its soft-drink products shipped to the United States, ensuring concentration levels do not exceed 100 parts per billion, and to test the beverages following agreed-upon protocols....
