Wyndham Loses Bid To Toss Timeshare Whistleblower Suit

Law360, Los Angeles (July 12, 2016, 4:49 PM EDT) -- Wyndham Worldwide Operations Inc. must face accusations that it retaliated against two whistleblowers who raised concerns about fraudulent timeshare sales practices, a California federal judge said Monday in an order that criticized the hospitality giant for relying on muddled arguments.

U.S. District Judge Otis D. Wright II shut down Wyndham's motion to dismiss, saying that the two suing former employees can rightfully bring claims against the company. But he said that Wyndham's motion, which also asked for summary judgment in the alternative of a dismissal, represents an example of how composite motions can cause blurry arguments.
