Suit Against Subaru Over Gas Odor Dismissed

Law360 (January 27, 2009, 12:00 AM EST) -- A federal judge has handed a win to Subaru of America Inc., dismissing a class action that accused the automaker of negligence and demanded that it cover the costs of fixing a pervasive fuel odor caused by an alleged defect in some vehicles.

In an opinion passed down on Monday, Judge Jose Linares of the U.S. District Court for the District of New Jersey granted Subaru’s motion to dismiss the second amended complaint.
