TiVo Patents Reinstated As New Judge Reapplies Alice Test

Law360, Los Angeles (November 29, 2016, 9:34 PM EST) -- A New York federal judge on Tuesday tossed out a decision invalidating three TiVo Research and Analytics patents from a now-retired judge, saying the judge incorrectly applied the U.S. Supreme Court's Alice decision to the targeted-advertising technology.

The case stems from a dispute over the TiVo subsidiary's patented advertising platform technology brought by TNS Media Research LLC. A February decision from U.S. District Judge Shira A. Scheindlin said TiVo's patents didn't pass muster under the Supreme Court's 2014 decision in Alice Corp. v. CLS Bank International, which found that abstract ideas implemented using a computer are not patent-eligible.
