NY Couple Awarded $47K After Post-Ch. 7 Discharge Pursuit

Law360, New York (December 2, 2016, 8:37 PM EST) -- A New York bankruptcy judge on Thursday awarded a couple more than $47,000 in sanctions against banks including Wells Fargo and the law firm Duane Morris LLP for violating a bankruptcy discharge injunction multiple times by attempting to foreclose on the wrong property.

Husband and wife Jon Dogar-Marinesco and Manuela Mihailescu had a piece of property foreclosed on in 2010 after being discharged from their Chapter 7 bankruptcy proceedings in 2009, and they repurchased a second,16-acre parcel they used to own from the bankruptcy trustee.
