Harry And David Sues Rival Over Keyword Trigger

Law360, New York (February 11, 2009, 12:00 AM EST) -- Gourmet food and fruit purveyor Harry and David Holdings Inc. has sued rival Hickory Farms Inc. for purchasing the keyword trigger “Harry and David” from Google and other search engines.

Oregon-based Harry and David filed the trademark infringement lawsuit on Monday in the U.S. District Court for the District of Oregon, claiming that Hickory Farms misleads consumers who search for Harry and David by directing them to their site, instead of to Harry and David’s.
