4th Circ. Says DirecTV Must Face Technicians' OT Suit

Law360, New York (January 25, 2017, 6:28 PM EST) -- DirecTV must face two consolidated lawsuits from former satellite technicians who claim they were misclassified as independent contractors, the Fourth Circuit held Wednesday after finding that a lower court incorrectly concluded that the entertainment provider wasn't a joint employer under the Fair Labor Standards Act.

In a published ruling, a three-judge panel ruled that the technicians presented a plausible claim that they were jointly employed by DirecTV and an installation services provider and that both entities could be held liable for overtime violations.
