Law360, Chicago (January 26, 2017, 6:27 PM EST) -- An Illinois federal jury on Thursday sided with Zimmer Inc. in the third bellwether trial over the medical device manufacturer’s NexGen knee implant, rejecting the plaintiff’s claim that the company dodged its responsibility to warn her doctor that the implant could fail in obese patients.
In the third bellwether win for Zimmer in the massive multidistrict litigation over the product, the jury took less than a day to determine that Zimmer did not fail to warn Beverly Goldin’s surgeon about the risks she faced from a knee replacement as a result of her obesity, or her potential need for revision surgery....
