Moving Co. Escapes 'Skeletal' Wage-And-Hour Suit

Law360, New York (February 23, 2017, 3:07 PM EST) -- Atlas Van Lines escaped a wage-and-hour suit Wednesday when a California federal judge found that the proposed class of California drivers hadn’t provided enough facts to back up their “skeletal” claims that the moving company violated the state’s labor laws.

U.S. District Judge George H. Wu dismissed all of named plaintiff Frank Leitzbach’s claims, giving him until March 7 to amend all but one of them. The claim that was permanently dismissed was Leitzbach’s allegation that Atlas failed to pay all wages owed every pay period — a claim for which Leitzbach had no private right of action, the judge said....
