NY Court Affirms Ford's Escape From $11M Asbestos Verdict
Law360, Los Angeles (March 1, 2017, 4:47 PM EST) -- A New York appeals court on Tuesday upheld Ford's post-trial disposal of an $11 million jury verdict in a suit over an auto mechanic's mesothelioma-related death, ruling the trial court correctly set aside the verdict because there was insufficient scientific evidence linking Ford's products to the man's disease.
A four-judge panel ruled 3-1 to affirm Judge Barbara Jaffe's post-trial ruling setting aside the verdict against Ford Motor Co. on the grounds that plaintiff Mary Juni had failed to provide sufficient expert evidence linking her deceased husband Arthur Juni's disease to his exposure to Ford auto parts containing asbestos.
