2nd Circ. Remands $15.6M Claims Award V. Delta

Law360 (March 6, 2009, 12:00 AM EST) -- A federal appeals court has vacated a district court’s award of $15.6 million in tax-related claims to Lone Star Air Partners LLC in the Delta Air Lines Inc. bankruptcy after finding that the language in the leveraged aircraft lease between the two parties was ambiguous.

In a summary order issued Thursday, the U.S. Court of Appeals for the Second Circuit opted to return the dispute to the bankruptcy court for an evidentiary hearing on the dispute.
