Cox Doesn't Have To Let AT&T Show Padres: FCC

Law360 (March 9, 2009, 12:00 AM EDT) -- The Federal Communications Commission has denied AT&T Inc.'s bid to force Cox Communications Inc. to sell it the rights to broadcast San Diego Padres baseball games.

The FCC issued its ruling on AT&T's unfair competition complaint on Monday, finding that there is no basis for requiring Cox to make its Cox-4 channel available to AT&T, because it is broadcast terrestrially. Section 628(b), the unfair competition provision of the Communications Act, only applies to satellite cable programming, the commission found.
