Judge Rejects Flight Attendant Class Action Lawsuit

Law360, New York (August 29, 2006, 12:00 AM EDT) -- A federal judge has denied a flight attendant’s motion to file a class action lawsuit against her former employer Northwest Airlines Corp. in its Chapter 11 bankruptcy case.

The flight attendant, Christine Mercek, worked for Northwest from March 1988 to January 2001. After she left the company, she continued her health insurance under COBRA.

Mercek’s COBRA coverage was discontinued after an alleged missed payment, which she claims violates the Employment Retirement Income Security Act. She is seeking injunctive relief and money damages for “deprived medical benefits...
