11th Circ. Affirms Win For Fla. Developer In $12M Hotel Fight

By Carolina Bolado (June 27, 2017, 4:51 PM EDT) -- The Eleventh Circuit has affirmed a defense win for a Florida developer who defeated $12 million in fraud claims brought by two Middle Eastern companies over a hotel project investment, ruling there was nothing wrong with the trial court's instructions to the jury.

In a June 22 decision, the appeals court rejected arguments from plaintiffs Al-Ghena International Corp. and Shairco New Jersey that the trial court's jury instructions regarding a "waiver" affirmative defense to their fraudulent inducement claim were impermissibly confusing and misleading.
