Fed. Circ. Faults PTAB's OK Of Intellectual Ventures Patent

Law360, New York (July 10, 2017, 5:00 PM EDT) -- The Federal Circuit ruled Monday that the Patent Trial and Appeal Board failed to adequately explain why it upheld some claims of an Intellectual Ventures touch-screen patent in an inter partes review, giving Google Inc. a new shot at getting the claims invalidated.

Of the 22 claims of the patent that Google challenged, the PTAB found that 11 were invalid and 11 claims were not invalid. Both companies appealed, and the Federal Circuit upheld the board's decision on the claims that were found invalid, but vacated its decision on the claims that were found not to be invalid.
