Law360, Los Angeles (July 10, 2017, 10:46 PM EDT) -- A California judge on Monday changed course from her prior tentative ruling and dismissed Imerys Talc from an impending trial over claims that a woman’s ovarian cancer was caused by Johnson & Johnson products made with Imerys-supplied talc, saying Imerys can’t be sued for supplying an “inherently safe” ingredient.
Last Wednesday, Los Angeles Superior Court Judge Maren Nelson issued a written tentative ruling indicating she would partially deny Imerys Talc America Inc.’s motion for summary judgment as to plaintiff Eva Echeverria’s claims, which were originally set to head to trial this week.
