Judge Denies Apotex Bid For Stay On Injunction

Law360 (September 5, 2006, 12:00 AM EDT) -- Apotex Corp. lost another battle in its war to get its generic version of Plavix to the market Friday, when a federal judge refused to stay a preliminary injunction halting shipments of the blood thinner while the company appeals.

Judge Sidney H. Stein of the U.S. District Court for the Southern District of New York denied Apotex’ request, meaning the injunction will be in effect until the pending patent infringement lawsuit is resolved. A trial is set to begin on Jan. 22, 2007.
