Feds Urge 9th Circ. To Restore Seal Threatened Status

Law360, New York (October 24, 2017, 3:44 PM EDT) -- The National Marine Fisheries Service has urged the Ninth Circuit to restore the Arctic ringed seal’s status as “threatened” under the Endangered Species Act, saying the appellate court should reject arguments from oil and gas industry groups.

The federal government on Friday filed a reply brief in an appeal of U.S. District Judge Ralph R. Beistline’s ruling that undid the NMFS’ decision to list the Arctic ringed seal as threatened. The judge had said the decision was arbitrary and capricious because it was based on speculation about the impacts of climate change on the subspecies as far out as 2100....
