Too Late To Sue MetLife Over Contract: 5th Circ.

Law360, New York (April 30, 2009, 12:00 AM EDT) -- A federal appeals court has upheld the dismissal of a proposed class action against Metropolitan Life Insurance Co. alleging it shortchanged its insurance policyholders out of dividends they were entitled to receive more than 20 years ago, ruling that the plaintiffs' breach of contract suit was correctly dismissed as time-barred given that evidence of their injury was not "inherently undiscoverable."
