Deutsche Bank Faces Privilege Waiver Over Log In RMBS Suit

Law360 (July 24, 2018, 10:19 PM EDT) -- A New York federal magistrate judge said Monday that RMBS trustee Deutsche Bank National Trust Co. has run out of chances to come up with a proper privilege log for investors suing it over its handling of a number of RMBS trusts.

Finding that it had “failed to provide an adequate privilege log notwithstanding multiple opportunities to do so,” U.S. Magistrate Judge Sarah Netburn said that Deutsche Bank will be deemed to have waived its privilege on almost all the documents included in the log except for where it can show those documents have been adequately described and are actually privileged....
