Capital One Sued For Checking Credit Info Post-Bankruptcy

Law360 (March 12, 2018, 2:01 PM EDT) -- Capital One Auto Finance Inc. was hit with a putative class action in California federal court on Friday accusing it of obtaining a San Diego woman’s consumer credit report weeks after her debt with the lender was discharged through bankruptcy.

Ophelia Augustine claims Capital One submitted an unauthorized account review credit inquiry to Experian weeks after her debt and account with the lender was closed, and is hoping to bring class claims for violations of the Fair Credit Reporting Act.
