Merchants trying to force American Express Co. to eliminate rules banning retailers from offering customers incentives to use cheaper payment methods argued Monday that their antitrust class action didn't belong in arbitration despite a recent U.S. Supreme Court ruling.

A New York federal judge ruled Friday that American Express Co. must produce papers in an antitrust class action that it had previously provided to the U.S. Department of Justice, finding AmEx had waived attorney work product protection for the documents.
