Juvenile Processing Deadline Ignores Evidence, Feds Say
Law360 (July 21, 2021, 7:43 PM EDT) -- A Washington federal judge abused his discretion and ignored evidence when he ordered U.S. Citizenship and Immigration Services to process petitions from abused and abandoned young adults within six months, the Biden administration argued in its Ninth Circuit opening.
U.S. District Judge Robert S. Lasnik's permanent injunction last October requiring USCIS to adjudicate applications for Special Immigrant Juvenile status from Washington state residents within 180 days stripped the agency of its authority to oversee the program, ignored existing difficulties facing USCIS and created new problems, according to the agency's Tuesday brief.
