9th Circ. Chucks Bluetooth Deal Due To High Atty Fees

Law360, New York (August 19, 2011, 6:57 PM EDT) -- The Ninth Circuit on Friday vacated an agreement settling product liability litigation over failure to warn of the risk of hearing loss associated with Bluetooth headsets, ruling the $850,000 attorneys' fees were too high in light of the plaintiffs' negligible recovery.

The appeals court remanded the issue to the Central District of California, saying the lower court needed to re-evaluate the settlement's disproportionate attorneys' fee award.
